Terms of Service for High School Bowling Stats

1. Introduction
Welcome to High School Bowling Stats ("we," "our," or "us"), a service provided by Nexus Web Labs, LLC. By accessing or using our website and services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the Terms, you may not access the Service.
2. Definitions
- "Service" refers to the High School Bowling Stats website and all related services.
- "User" refers to anyone who accesses or uses the Service.
- "Coach" refers to a User with permissions to add and manage team statistics.
- "Organizational Admin" refers to a User with administrative permissions for an organization.
- "Organization" refers to a school or entity that has subscribed to the Service.
3. Eligibility and Geographical Restrictions
3.1. The Service is available for viewing to Users of all ages. However, to create an account and add statistics, you must be at least 18 years old.
3.2. The Service is only available for use within the United States of America.
4. Registration and Account Management
4.1. To access certain features of the Service, you must register for an account.
4.2. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
4.3. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.
4.4. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
5. User Roles and Responsibilities
5.1. Organizational Admin:
- Is responsible for managing the organization's subscription and payments.
- Can invite and manage other users within the organization.
- Can designate other users as Coaches or Organizational Admins.
5.2. Coach:
- Can add and manage statistics for their assigned teams.
- Must provide accurate statistics and scoring to the best of their ability.
5.3. All Users:
- Must not enter false information or inflate statistics.
- Must be respectful of others and prioritize fairness in all interactions.
6. Subscription and Billing
6.1. The Service is provided on a subscription basis. The current annual fee is $149.
6.2. Subscriptions are billed on a yearly basis and will automatically renew unless cancelled.
6.3. You can cancel your subscription at any time through the user button located in the upper right-hand corner of the application on desktops or at the bottom of the mobile menu.
6.4. If a subscription is not renewed, the organization's status will change to "Past Due" and enter a 30-day grace period. If payment is not updated within this period, the status will change to "Expired," and access for all organizational users will be deactivated.
6.5. Email reminders for subscription renewal will be sent 30 days, 14 days, 7 days, and 24 hours before renewal. Emails for cancellation of service will be sent 30 days, 14 days, 7 days, and 24 hours before termination of service.
7. Refund Policy
We offer a 30-day refund policy. If you are unsatisfied with the Service, you may request a refund within 30 days of your initial purchase.
8. Data Collection and Privacy
8.1. We collect users' first name, last name, state of residence, and email address.
8.2. We do not sell or share user data under any circumstances unless compelled by legal agencies with a subpoena.
8.3. Data is secured through our third-party database provider, Neon Tech. Their terms of service and privacy policy can be found at https://www.neon.tech.
9. Content and Data Accuracy
9.1. Users are responsible for ensuring the accuracy of all data entered into the Service.
9.2. If you believe any statistics are inaccurate, please use our contact form to initiate an investigation.
9.3. High School Bowling Stats and Nexus Web Labs, LLC are not responsible for the accuracy of any data entered by users, including names and ages of players.
10. Player Privacy
10.1. Player names must be accurate unless a player notifies their coach or the administrators of the site that they would like their name removed.
10.2. In cases where a player requests name removal, their name will be converted to "Player x" where x is an auto-incremented number.
11. Data Retention and Export
11.1. Data is kept for 10 years as long as the application is live.
11.2. If the application is discontinued, a backup of data will be made available for free to the public.
11.3. Organizational data is not deleted if the organization chooses to discontinue their membership. It is kept for 10 years like all other data.
11.4. Users can export data in CSV format using the download button where available on the site.
12. Intellectual Property Rights
All intellectual property rights for the content on the platform belong to Nexus Web Labs, LLC, the creator of the application.
13. Limitation of Liability
13.1. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, and hereby disclaim and negate all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
13.2. In no event shall High School Bowling Stats or Nexus Web Labs, LLC be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
14. Third-Party Services
We utilize the following third-party services:
- Clerk (https://www.clerk.com) for authentication
- Vercel (https://www.vercel.com) for hosting
- Neon Tech (https://www.neon.tech) for database services
Your use of the Service is also subject to any applicable terms of service or privacy policies of these third-party providers.
15. Account Transfers
Accounts can be transferred without fee. This is done through the administration dashboard of the Organizational Admin.
16. Modifications to the Service and Terms
16.1. We reserve the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.
16.2. We reserve the right to modify these Terms at any time. We will notify users of any changes via email and will require agreement to the new terms when accessing the application for the first time after the change.
17. Dispute Resolution
We will attempt to resolve any disputes internally. However, we reserve the right to use arbitration if necessary.
18. Termination
18.1. We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
18.2. Upon termination, your right to use the Service will immediately cease.
18.3. User accounts are initially deactivated and can be reactivated within 90 days of deactivation.
19. Governing Law
These Terms shall be governed and construed in accordance with the laws of [Your State], United States, without regard to its conflict of law provisions.
